        China rectifies and standardizes Housing leasing

In the past, the hot but frequent problems of long-term apartments will usher in more stringent regulation. The Ministry of housing and urban rural development of China and other six departments issued the latest opinions to rectify and standardize the order of the housing rental market, put forward to guard against the financial risks of housing rental, make clear requirements on the loan term and loan amount of the housing rental loan business, and strengthen the supervision of high-risk housing rental enterprises that adopt the business models of "high in and low out", "long in and short out".
According to the opinions on rectifying and regulating the order of the housing rental market released on the website of the Ministry of housing and urban rural development on Wednesday and related press releases, there are problems in the housing rental market, such as publishing false house source information, maliciously withholding the deposit rent, illegally using the housing rental loan, forcibly expelling the lessee and so on, which infringe on the legitimate rights and interests of the renters and affect social harmony and stability.
The opinions requires strict registration and filing management. Real estate agencies, housing rental enterprises and network information platforms engaged in housing rental activities, as well as units or individuals who sublease more than 10 sets of housing, shall handle the registration of market subjects according to law; those who have already filed and released the housing information to the public shall be responsible for the authenticity and effectiveness of the housing information.
The opinion also requires controlling the leasing financial business, strengthening post loan management, strictly examining the purpose of the loan, preventing the housing leasing enterprises from forming capital pool and increasing leverage; the housing leasing enterprises shall not require the lessee to use the housing rent consumption loan by concealing, deceiving, forcing, etc., and shall not induce the lessee to use the housing rent consumption loan in the name of rent installment, rent preference, etc.
